Fee Schedule

Estates and Trusts are billed in one of the following three ways, whichever is greater:

1.  Fiduciary will charge a minimum monthly fee of $500 for servicing accounts. (Excludes Accounting Preparation Services)

2.  Hourly services at the following rates Trust Administration:

a)  Professional Fiduciary Services – Standard Rate: $225/hr

b)  Professional Fiduciary Services - After Hours/Holiday Rate: $250/hr

c)  Court Hearings, Trial Preparation, Depositions: $350/hr

3.  A percentage of the fair market value of the estate/trust:

a)  1.5% of fair market value of the first $1,000,000

b)  1% of fair market value of the next $10,000,000.

c)  1/2 of 1% of the fair market value in excess of $11,000,000

Please note that in the capacity(s) that we will be retained to serve, we may be required to engage the services of an independent attorney or other professionals to assist in your representation.  These costs are paid directly by the Trust, Conservatorship, Estate, Client, Corporation or other Legal Entity. These fees, costs and expenses are not part of this firm’s compensation and will be passed on at cost.

Fees are invoiced monthly and paid from client funds.  Fees paid from decedent estates or Conservatorship funds are only paid upon court approval. Conservatorship invoices for Santa Clara County will be paid 40% prior to court approval (Rule 11 V.(4)). If the court previously granted periodic payments on account of conservatorship fees pursuant to Probate Code Section 2643, those periodic payments will instead be collected.

Normal travel time is billed at Fiduciary’s standard rate for one direction. Any long-distance travel (over one hour) is billed at Fiduciary’s discretion.

Reimbursement will be made directly from the estate for expenses such as postage, copying faxes, travel, mileage and parking.  Other administrative costs will be billed at a flat rate of 4% of the monthly charges.
